rajvir Posted June 20, 2011 Report Share Posted June 20, 2011 MY i-140 is approved on 1st of june, my 1st term h1 is getting over in sept. i want to change the current employer. what if my old employer cancel my i-140. i have below questions. 1)i know employer can only cancel i140 under fraud and misrepresentation. but what if my old employer cancels my i-140. My new company is ready to do h1 transfer and start my gc process as well. will i lose my priority dates. 2)what if my old employer does not give me the copy of i-140. how can i get it? thank you in advance for your help rajvir Link to comment
Belle Posted June 21, 2011 Report Share Posted June 21, 2011 1) Incorrect. Employer may withdraw at any time before your I-485 is approved. You will retain the PD if it is a simiple withdrawal (i.e. the position is no longer available to you). 2) You may file an FOIA request. Link to comment
