Hi Seniors

 

I am upgrading my Green Card process from the EB3 to EB2 category. My question to you is

If my petition in EB2 gets denied, does my original EB3 process continue as before or does that get affected as well?

Any advice seniors? I know I may be asking a very basic question but the answer will give me a relief.

If your EB2 (I-485) petition is deined, and your employer has not withdrawn your approved EB3 I-140, you will be able to file another I-485 based on the approved EB3 I-140 when the EB3 PD gets current. Hope this helps.

These are independent (other than PD) petitions considered on their own merits. Denial of one does not impact the status of the other.
