Filing green card in EB1 exceptional category, currently on H4

Recommended Posts

Hello,

I am an H1B IT professional, with PhD in Physics from a reputed US university. My wife, physics PhD with post-doc from Cambridge, UK, has over 30 publications in her field, recently held professor position in an Indian University. She can get recommendation from the top people from her field. Given that I am earning good and we have a kid, she left her job and currently joined me on H4 in US. Her intention is to finally get a position in US in her field, but as of now she did not try for any job because on H4 she can't work. Hence we are researching what are the options for filing green card. My green card has not been filed yet.

Can any one here shed some light if she herself can file EB1 in exceptional category? If yes, what documents she needs to gather? If no, why and what are her options?

Thanks in advance.

If she is good enough for EB1, she be able to get a job.  As you have found out, PhD jobs in physics are very hard to find due to an overproduction of graduates. It is not unusual for over 150 applicants for a single job. That is why you are working in IT. A GC is unlikely to help in the job search, unfortunately, and may even hurt due to salary expectations.

My Opinion is different from t75. Getting someone to sponsor you for a job even if you are exceptional is difficult ( other than IT :)) . My wife though exceptional in her field found it difficult to get a job but after getting her O1 approved she had multiple job offers lined up. You should surely talk to a lawyer most do the initial review for free or may be charge 200-300$ which will be worth it. Getting an application ready for O1/EB1 is time consuming.
