Dependent travel while on EAD w/ AP. Unemployed

Hi all,

 

I currently have my EAD with AP as a dependent (as part of my spouse's EB1 application).

I am currently employed -- however, I intend to change jobs in the very near future. Additionally, I intend to travel to India in the next couple of months. There is a chance that I may be unemployed at the time of travel. (However, my spouse will continue to be employed).

My question is -- is it ok for a dependent with EAD+AP to travel without a job in hand? Should I expect any additional questioning/trouble with the immigration officers upon re-entry under these circumstances?

It is absolutely OK. There will be no additional questioning because of this. You will go for secondary inspection and will be paroled in to await AOS.

I have received my EAD w/ AP as an EB1 dependent of my spouse. I am still awaiting my I-485.

If I were to quit my current job, is there a limit on the number of days of unemployment I can have before I receive the AOS?
