Depending on the situation, a person may be able to stay to have another employer file a petition, but will be out of status from the termination of employment to the approval of the new H-1B. If it is approved without I-94, the person generally needs to leave the US and apply for a visa in home country. Their is no grace peroid. Either find another employer or change your status to dependent if you are eligible.
