anynemous
Hi , As part of GC process, when employer/attorneydecides in which category they have to file (EB1/EB2/EB3)? Is it while filing PERM to DOL? Is it after getting approval from DOL and before the start of advertisement? Please help me on the same. Thanks. Link to comment
rahul412
The Job description and its details will decide the category. An exp attorney can tell it after reading the Job description. Link to comment
anynemous
Thanks for your reply. But when they need to mention it in process, while filing PERM? Link to comment
pontevecchio
They do not decide. Based on the job requirements and your credentials the I-140 designation Eb2 or EB3 is decided at the time of I-140 approval. Link to comment
t75
It would never be listed in advertisement. Link to comment
