chirag 0 Report post Posted January 15, 2014 My 6 years on H1 B Visa is expiring in August 2014, my attorney filed Labor , in Dec.2013, & now he is asking for me to leave the country for 6 months, so that he can apply for my H1B extension.I do not want to leave the country, How can I skip leaving the country? pyrimidine 0 Report post Posted January 15, 2014 there are few "Ifs and buts" in your case. Labor can take anywhere from 3 to 9 months for the approval. Say "if" you get your labor approved in june/july 2014 (I am averaging it to six months), you can file for I-140 with premium process. If you get I 140 approved (if there are no RFEs and you get your approval in 15 business days), you can get three years of H1b extension beyond six years. or Change status to H4, if you have the option.
