I am in the same boat with H1 transfer denied and I-94 expired. Planning to file an appeal. I know we are not legal to work during the appeal period. Can we stay in this country during that time or do we have to leave to India ?

My H1B got denied on Nov 28 so my employer filed MTR on Dec 28, 2016, and on Jan 13, 2017, they received my application.

Till today there are no updates on my case. I have tried raising a ticket through ombudsman in July 2017 and there is no luck.

My employer is not raising service tickets with the uscis.

My question is there any other ways I can able to contact with USCIS.

Thanks

Hello,

Few days ago my H1B got denied and my H1B visa and I94 expired in Sep 2017. The reason for the denial is : EE and Specialty occupation. My attorney is planning to refile the application, can anyone share their experience in a similar situation or the options that I have.

How long can I stay in this country and whether I can continue to work or not.

Thanks,

Hello All,

My company applied for my H1B in April 2017, and it was denied due to Level-1 wage reason. My employer appealed for it in November 2017.

Currently status of my H1B appeal on USCIS website shows:

Name Was Updated

On February 13, 2018, we updated your name for your Form I-290B, Notice of Appeal or Motion, Receipt Number WAC**********. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.

Could someone please tell me the meaning of this status? Also, did anybody else see the same update too?

Thank you.

For motion to reopen it’s 90 days.

your attorney or employer can do it.

i heard some of getting results in week or two week after service request.

Hi,
My H1-B petition was picked in 2017 and was denied due to EE relationship and Specialty occupation. My employer has filed an appeal for the petition on Jan4th and documents were delivered in Washington on Jan 5th. Since then I have been tracking my old case number but the case number says Decision notice was emailed which was updated in Nov. Since the appeal, nothing has changed. I saw in other posts people posting that when their appeal was made for the petition, the case status changed after their petition was appealed to case was received etc. I am concerned. Could you please shed some light and let me know if there is any way to find out on the status of the appeal.

Thanks in advance.

You should get a new receipt number to track the status of the appeal. Ask your employer once.
