iaquil Posted December 5, 2013 Report Share Posted December 5, 2013 PD Feb 2013. My company filed perm on Feb 2013 and got a response on Sep '13 that it went under audit. As per the attorney - "its a random audit asking recruitment process, employee referral program and a sign affidavit for nonpayment of fees". Co. attorney has filed the response immedialty. Right now the audit processing timeline is for Oct 2012. I think by the time I get any answer it will be 2014 April/May and my H1b is expiring Sep 2014. I am concerned as should I wait or withdraw this labor and file again (I know I will be losing PD). I am fulltime with a MNC based in mid west, (not in cog, tcs,ibm, wipro and so on..) Any response would be highly appreciated. Link to comment
Attorney_15 Posted January 10, 2014 Report Share Posted January 10, 2014 PERM cases do get audited and withdrawing a case after filing the audit response does not mean that another case filed will not be audited. It does mean the loss of a basis for extending H1B status beyond the 6 year limit. Link to comment
