New employer will file PERM during early 2014 and asked me to travel to offshore around Aug 2014 and wait until PERM/I140 is approved. There are no recapture days left. 1) Is it possible to apply for H1 xten based on the approved I140 while outside US? 2) Can i travel immediately after H1 xtn approval? Link to comment
irarum Posted November 13, 2013 Report Share Posted November 13, 2013 1. Yes. so called GC processing (PERM and subsequent steps) is for future employement. 2. yes once you get it stamped. Please understand that PERM + 140 could take significant time. And get prepared accordingly. Link to comment
pradeep06 Posted November 20, 2013 Author Report Share Posted November 20, 2013 Thank you, my employer has already started the initial steps for PERM filing with a target filing ~Mar 2014. Hoping to get out of US in Aug and all goes well, re-enter Mar 2015. Link to comment
