DSO is not reinstating my SEVIS

I got my H1b approved but Change of status was denied so I have no I-94. I go to school as well and was working in CPT.

 

On october 1st, my SEVIS was auto-terminated since H1b was not effective due to Change of Status. 

 

Now i asked my DSO to do the "data fix", he refuses and asked me to drop out of school for no reason than this data error.

 

What can i do?

That's the reason for COS rejection. You are currently illegal, so get your H1 visa ASAP.

For any COS denied, you have to leave country and get stamping done.

Using school simply to get CPT employment authorization so you can work is trying to get around immigration laws, regulations, and rules, which is its own problem.  This could also be part of the issue.  It appears that you need to leave the U.S. as you do not have lawful status, and then come back when you have an approved H-1B visa.
