URGENT: EAD RFE Denied, what are the options?

Hi everyone,

 

My 1st year EAD was expiring on 7th August 2013 so I applied for EAD extension. I got a RFE on it in mid-August. They asked me for following things:

1) My every employers name from 8th Aug 2012(when my EAD started) to current.

2) My job title and job responsibilities at all jobs from 8th Aug 2012 to current.

2) All the pay stubs from 8th Aug 2012 to current.

3) My W-2 for the year 2012.

 

I replied them with all the requested documents in Sept first week except my W-2 for year 2012 as I worked as an unpaid intern from Oct 2012 till March 2013 and in mid-march I I got a new paid job.

So i produced all my pay stubs from March'13 till August'13. And as an unpaid intern is allowed in the 1st year of OPT I didn't provide them with any pay stubs before March 2013 and no W-2 for 2012(which I think is fine according to the law).

 

TODAY the USCIS updated the decision on their site as EAD denied. They haven't mentioned the reason yet, I will know the reason in the letter I receive next week. Whatever the reason is but my EAD is denied and the 1st year of OPT is also over.

SO MY DOUBTS ARE:

 

1) Should I consult a lawyer and file a case as I feel all my documents were satisfactory.

2) How much time do I have to do this procedure? How many days of probation is offered in such cases?

3) Should I take an admission in a school which offers CPT right away to maintain my status and job?

4) What happens to my current job? Do i need to resign or I can continue till I get the result of my filed case?

You DEFINITELY should consult an Attorney...I thought they submitted these docs in the first place...you are not a profesional in Immigration matters..they are. So let them handle this.

 

Admission to Univ to get CPT is a VERY VERY BAD Idea...dont even try that..you might get deported.

 

Dont you have H1?

*PLEASE REPLY PEOPLE, IT'S REALLY URGENT*

Wait till you know the reason for rejection. Don't ever think of CPT, you will lose the chance of getting H1.
