Nagesh
I have an offer with a new employer but the degree requirement is "Bachelors + 4 years" of experience. My I-140 was approved with "US Masters Degree" with 0 experience. Will this be an issue with while invoking AC21? Link to comment
Nagesh
Dear Attorney's can you please advice me on this. Question: Should the educational qualification in the PERM application MATCH with the educational requirements of the new job while invoking AC21? My PERM & I140 is approved for Masters degree+0 exp ender EB2 while the new job requirement needs Bachelors + 4 years of exp? Please advice. Link to comment
Belle
The first question you need to answer - why would the USCIS even see the educational requirements for the jobs? Link to comment
Nagesh
First, thank you . I am not aware of the AC21 rules.I was in an assumption that if the Job duties match that would qualify me to invoke AC21.However, while doing some research on the internet about this I could see USCIS sending out RFE's asking for Employment verification letters with the Job duties and Education qualification. Please clarify why is USCIS asking for this? Have the AC21 rules changed recently? Link to comment
