I had filed H1B Visa through a consultant in 2008, the petition was approved, but I never got it stamped.

 

I have the just receipt number and consultant is not responding to my requests for the I797.

 

Can I file H1 under cap exempt category just with the receipt number ?

I believe a new employer can file a cap exempt H1B petition for you with a receipt number.
