vabbaraj Posted February 5, 2011 Report Share Posted February 5, 2011 I quit my old job for a much better job. New company said they will transfer my H1 visa. My last day of work at my old job was 12/30/2010 first day of my new job is 1/4/2011 My HR is saying that they just received prevailing wage determination from the DOL and they are starting my LCA and H1B transfer process on 2/3/2011. Questions: 1. Did I acquire any illegal status? 2. what is the best course of action for me? Should I exit the country till I get my approval? 3. Would USCIS approve the transfer as this delay is because of processing at DOL? I started working without any receipt from USCIS and now it is over a month. I only found out that this might be a problem after reading through this forum. please advise Link to comment

vabbaraj Posted April 26, 2011 Author Report Share Posted April 26, 2011 My company did not do the premium processing (they are saying it wouldn't make a difference). I am getting paid from 4 months( since my start date 1/4/11). Application went to USCIS only on 3/28 and I got receipt on 4/7. My company's attorney dont know what could happen due to this delay.
