Is it possible for my employer to apply for PERM now as I am in my last year of H1 expiring Sept 2013? I have 5 years of experience with 2 years from a different employer. Please help. randb Posted May 29, 2013 Report Share Posted May 29, 2013 Not true. I'm in the same boat. I did 100% of my masters while working. My company is filing in EB2. There are some ways to get around this. Just talk to the attorney. My company is using Fragomen. Link to comment

randb Posted June 2, 2013 Report Share Posted June 2, 2013 I think there is a 51% or more rule. Something like 51% of your GC job should be different from what you were doing while earning your Masters degree. My GC position is that of a manager, vs an analyst now, so they were able to justify that my responsibilities will be different. Link to comment
