PhD Student graduating in May 2013 - Seeking feedback on eligibility for EB1 filing

Greetings.

I am seeking to find out whether a person with the following status will be eligible for EB1 filing.

Please provide your feedback after reviewing the case details given below. Let me know if you need more information

Current Immigration Status: F1 (Valid Till May 2014)

I have held an valid active F1 since Aug 2007

Graduation Date: May 11, 2013

Education Qualification

  • Offered a fully paid Post Doc at my current University
  • Ph.D. in Infrastructure and Environmental Systems (GPA 4.0/4.0)
  • Masters in Environmental Engineering (GPA 3.9/4.0)
  • Bachelors in Chemical Engineering from RVCE Bangalore

Jobs / Internships - Positions Held

  • Research Assistant - Jan 2011 to Present
  • Research Assistant - Jan 2010 to Dec 2010
  • Teaching Assistant - Aug 2010 to May 2012
  • Student Intern (Treatment Plan run by 'City of SFO' ) - May 2009 to July 2009
  • Student Intern - Jan 2009 to May 2009
  • Student Intern - Jun 2008 to Dec 2008

HI,

EB1 require outstanding accomplishments in your area of study. Having a couple of publications and presenting your graduation work (widely considered as your advisor's accomplishment) does not stand your case in this category. I would recommend you to consider filing 'NIW'.

An attorney with experience in these filings would be in the best position to advise you on your strength and weaknesses.

BTW. A postdoc is seen by many senior people as being not good enough for a "real" job. It certainly should be paid or why would you accept it.
