i-185 (Affidavit of support) Requirements with H1-B when spouse is not working

Recommended Posts

I am planning to apply for green card thru marriage.

My wife is a US Citizen.

I have a question for i-185 ( Affidavit of support).

She was working before our marriage and we relocated to other city after marriage. Right now she is not working from past 4 months.

My question is could i put my salary for i-185 form?

I also can show our joint account balance.

Is this will be an issue, if she is not working? She have w-2 form from last 3 years.

I been working in US for last 5 years.

Also, could we apply now with present documents and if she get a job in future, could we send the updated i-185 for future?

Please advise.

Assuming there are no dependent children immigrating also, the household income can generally be included on the Affidavit of Support. The Affidavit of Support is a complicated form with certain legal intricacies and requirements, and it is advisable to seek the counsel of an attorney to prepare and file the family based petition in certain circumstances.

Read the instructions first. I remember seeing something about including immigrant's income into the affidavit. Also, if the immigrant has accumulated 40 SS credits, the sponsor maybe exempt from the income requirement altogether.
