i need to go to india for an urgent family matter and my H1 started this october

My salary is currently less than that mentioned in LCA  but my employer provided a letter stating they will pay me the money owed from january 2014

Is it a big risk going to india to get stamping done in this situation?

in 221g case they ask , i have been asked at Mumbai in 2010.

Hi,

I had been to Chennai consulate along with my wife and kid on 01 March 2016.  

My case has been updated twice

1. 31 March 2016

2. 12 April 2016

On July 11, 2016 I received the email reply from the UStraveldocs that 

" The consulate is returning your petition to USCIS for further review."

After this, I am still getting email reply from UStraveldocs that the case is in 'administrative processing

My petition approval is valid till November 23, 2016

I'm not sure in which stage is my case is stuck, even an attorney from Antone could not get any information.

My company has processed many  H1B applications in various client places, the client place where I need to work has 30 people, I am the first person to be placed in administrative processing, what seems to be the issue.

VO asked very few questions.

VO : Grim Face, not even looking at me, 
Me : Good morning, -- no answer
VO : Where is yous client place?
Me : xxxxxxx, Ohio
VO : Where you work now 
Me : Explained him that I am working for xxxxx, and US position is my new employment
VO : Asked my wife, how long you been married 
W  : Since xx/xx/xxxx
VO : Client-letter please
Me : Handed client-letter
VO : Your role is not clearly mentioned in the client-letter
Me : I explained my roles and responsibility
VO : Gave me yellow slip
Me : Waited for 2 hours, then i was called
VO : Gave me the Blue slip with only AP checked, along with the USA employee rights and told me it'll take few days, next time you don't have to take an appointment 
Me :  Asked him if any document needed
VO : Thank you..
Me : ......... 

I'm hoping for the best.

• Why is your pay less in last year W2?

• Show me your W2 worked for your employer.

• Show me your pay stubs

• Where do you work at?

• How do you like xxxxx place?

• Do you have any issues/problems with your employer?

• Do you have any one between your client and employer

• How come your Vendor found your client?

PER DIEM Questions:

Why per diem is on your pay stub? (It does not count as salary. Your salary has to match or exceed the salary listed on the LCA)

Why you didn’t have per diem earlier?

Why it’s only starting from this year?

Why you dint have per diem when project started?

BACHELORS/F1 VISA Questions:

• Where you did your bachelors? Is it technical?

• Did you do your undergraduate in US?

Note: Make sure that you Verify PIMS by sending an email to vancouverNIV@state.gov.

PIMS (verifying the details of approved petitions through the Petition Information Management Service (PIMS) via the Consular Consolidated Database (CCD)

Send this 1 week prior to your appointment to avoid 2-3 days of delay after your visa interview.

You will not get any response from the consulate but it works.

CLIENT QUESTIONS:

In case consulate send an email to Client for further processing. You may prepare your answers and send them to your Client manager if he/she is okay with it to reply as you mention. Here are the list of questions:

· Who (you/preferred vendor/petitioner) supervises the applicant, and is such supervision off-site or on-site?

Who does the applicant report to for work assignments?

Who completes the applicant’s progress reviews?

Who reports to the Client Manager? How often Client manager being reported?

· If the supervision is off-site and performed by the petitioner, how does the petitioner maintain such supervision i.e. weekly calls, reporting to the main office routinely, or site visits by the petitioner?

Ans: Bi-weekly status reports and status calls as needed.

· Who has the right to control the work of the applicant on a day-to-day basis if such control is required?

Ans: Both. Applicant employerand Client

· Who determines the direction of the project?

Ans: Client

· Who determines the applicant’s daily activities?

Ans: Employer

· Who provides the tools or instrumentalities for the applicant to perform the duties of employment?

Ans: Both. Employer and Client

· Who hires, pays, and has the ability to fire the applicant?

Ans: Employer

· Who claims the beneficiary for tax purposes?

Ans: Employer

· Who provides the beneficiary with employee benefits?

Ans: Employer

My Interview Experience

Step 1: Appointment was at 9:30 AM. I went to consulate at 8:00 AM. They checked my DS-160 confirmation, passport and I-797 and asked me to come back at 8:30.

Step 2: Went there at 8:30 and they checked my file and told me to remove the document from sealed envelope.

Step 3: Security check on 2nd floor and again checked the file.

Step 4: Submitted my DS-160, Passport and I-797 at counter 1. Waited there for around 15 mins until my number showed on screen. After that my number was showed on screen, took PP, DS-160 and I-797 from counter 1 and went to 20th floor where the actual interview was.

Step 5: Waited there for around 15-20 mins. I was sitting right across the Visa Officer who interviewed me. Then my number came and my interview was like this.

Me: Good morning sir, how are you? and gave him my passport, I-797 and DS-160 confirmation.

VO: Didn't say anything.

I put a big file with all the documents in front of him and opened it although he didn't ask for any document.

VO: For how long you are working for this company?

Me: 2 Years

VO: So you work in XX? (My employer address)

Me: No Sir, I work in YY(Client Address).

VO: So you work for a Client?

Me: Yes sir.

VO: Who is your Client?

Me: XXX

VO: For how long you are working for your client?

Me: 2 Years

VO: You worked for ZZZ before?

Me: Yes sir, I worked there for around 4 months when I was on OPT.

VO: What do you do for your Client?

Me: I am working as a XXX (Title) and told my responsibilities for about a min.

All this time he was typing something in the computer. I was keep telling him my duties and he stopped me in between and told me okay, I understand. I am approving your Visa. Gave me one white form for Loomis information and told me you can track your application here and you will receive your passport in 3-5 business days.

Me: Thank you very much Sir. Have a good one!!

Thats it. None of the documents were asked. The interview was less than 2 mins.

LITTLE TIP:

Main thing I noticed is to have a smile on the face and answer clearly in whatever VO asks and BE CONFIDENT and Try to be as cool as possible.

Trust in God. Carry as many documents as you can. Be confident while answering and answer them in a short sentence.
