Resigning the job while the H1b renewal is in process..

Recommended Posts

My employer had sent the documents to the USCIS under premium processing. I want to resign my job ASAP due to some personal reason. But I do not have any other opportunity at this point of time. The petition is in the "ACCEPTANCE" stage of the premium processing. If I resign my job now, are there any chance that my h1b will be denied by the USCIS people?

Though I would be resigning from the current client, I would still be with my employer and simultaneously search for a new client.

if i understand correctly you are not resigning from your current employer. you are planning to leave your client you are working for. if that is the case , that shouldnt be a problem as long as you dont get a RFE asking for your current client details.

That makes no sense. You are working for the H1 sponsor. If you want him to send you to a different client it is his problem as long as he wants to do the necessary amendments and continue paying you. Cannot you get a permanent job with a local company?

That's not called as resigning. That applies only for your employer. Anyway, your H1B extension is applied based on the project with your current client. It's advisable to stick to that client until your extension is approved. Then if you want to change the client, file an amendment with the new client.

I got my H1B approved last week and immediately I resigned from my client. Now my employer says that he had already terminated my H1B. Is he saying seriously or just threatening me?
