Background: We have recently applied for a 7th year H1/H4 extensions during the last week of September 2012 as they were expiring. We do have EAD/AP combo cards issued earlier this year (Feb). Questions: 1. We are planning to travel to India in the first week of January 2013, so we were wondering if there will be any issues at the port of entry during our return if we still don’t hear anything from USCIS regarding our pending H1/H4 extensions (OR) if there is a pending RFE? 2. I assume we can still use our AP at the port of entry while entering US? Appreciate any feedback! Kind Regards, S2024 Link to comment

Belle Posted October 23, 2012 Report Share Posted October 23, 2012 Well, not exactly. You may enter on AP and either work on EAD or continue in H1. Your H1, however, does not impact your AP entry - it only impact whether you may continue in H1 afterwards. If your H1 is approved, you will be presumed in H1 status. Link to comment
