hari_p76 Posted October 16, 2012 Report Share Posted October 16, 2012 I'm working in H1 right now and also maintain a valid EAD as well, even though, I did not use it to work as I never changed my employer. My wife is on H4. I just got an RFE for my H1 extension. If it gets revoked, I know, I can switch to EAD to continue working, but what are the options for my wife. Is she going to remain in valid H4 status or should we do something else, for her to have a valid status in US. Appreciate your response on this matter. Link to comment

JoeF Posted October 16, 2012 Report Share Posted October 16, 2012 If you are no longer on H1, your spouse is no longer on H4, because the H4 is tied to your H1. Has your spouse filed an I-485? If so, her status would change to "Pending AOS." Link to comment

She have AP which is getting extended every year. If she goes go to "Pending AOS" status, is there a approval paper like H4 or a card that she will have to show as a proof OR is the AP paper works as the proof. Thanks for the quick response. JoeF Posted October 17, 2012 Report Share Posted October 17, 2012 "Pending AOS" is not an official status. There is no form or other paperwork. She is legal due to the pending I-485. She needs AP to travel abroad, and if she wants to work, she needs an EAD. Link to comment
