srinum Posted October 2, 2012 Report Share Posted October 2, 2012 Hello Everyone, I am on Valid H1B visa and we are scheduling the H4 Visa appointment for my wife for Nov 5th and while completing the form there are 2 sections where it is asking for 1. Principle Applicant's Name 2. Priciple Applicant's Visa Status I want to know who will be the principle applicant here. Will it be myself( the H1B holder) ? Also there is another section which asks for the Petitioner Who will be the petitioner in this case ? Will it be my Employer who filed my H1B or myself ? I called the office and they tell that Principal Applicant and Petitioner will be the same i.e. name of your spouse who holds H1b. I am still confused because the i97 of spouse (H1b holder) says that the Petitioner is his company. Link to comment

For H1B holder the company/employer will apply and for spouse company/employer will not apply so the petitioner is not company but H1B holder itself Link to comment
