raunakkumar Posted May 29, 2012 Report Share Posted May 29, 2012 Can i legally work if L1 is Expired and i am in US till my I94 is Valid. in such case if someone files a fresh H1B..they should do change of status or fresh H1B. Can i work with other Employer if I94 is valid and l1 is expired. Please help. Link to comment
rohang Posted May 29, 2012 Report Share Posted May 29, 2012 1) Not sure about i-94 question (but I always assumed that we need to follow the earliest date out of "visa" or "I94), so not sure what a right rule. 2) I don't think you can work for any other employer till, you are L1 visa. luck2u Posted May 30, 2012 Report Share Posted May 30, 2012 You can stay and work on L1 till your I-94 expiry date though your L1 visa got expired. But you cannot work to different employer on your L1's I-94 on H1B or in any other status. Hope this helps your question! Link to comment

luck2u Posted May 31, 2012 Report Share Posted May 31, 2012 If you get H1B approval which is change of status i.e., L1 to H1B, you will get approved I-797 along with new I-94 for your H1B application. So, you can start working from October 1 on H1B and only when you leave United States you need to attend for H1B visa, till then you are legal to work on H1B and legal to stay based on new I-94.
