blueie Posted May 29, 2012 Report Share Posted May 29, 2012 Filled H1B with COS, Waiting for the approval .... I am in L1 in a client site. Assume, my petition got approved in a month or so. I have agreement of 'two weeks notice period' with my current employeer (L1B sponsor) and the agreement stats employeer has all rights to reduced the notice period based on the business needs. If I resign my job on 17th-Sep-2012 (2 weeks before my status change to H1B) and my employeer wanted to relieve me immediately (Assume 20th-Sep-2012). - What will be my status between (20th-Sep to 31th-Sep) ? (Though I have valid L1B and I94) - Staying with L1 without employement for a week or two, Is it legal ? WIll it create any issues ? - Is there any best way to overcome this, other than going back to my home country get my H1B stamp and comeback after 1st-Oct-12 ? wiweq Posted May 29, 2012 Report Share Posted May 29, 2012 Generally, good employer doesn't terminate in the notice period. The days you are not working with your L1 employer or H1b employer would be counted as out of status days (except a few weekend days). Link to comment
