Please advice - H1B Processing

Hello Friends,

I had to apply for H1B based on I-140 Approval for extension as I am going to finish my 6 yrs of H1B.

I have just 3 months left to finish 6 yrs . please advice whether I should go for premium processing or regular .

If I go with regular and if my h1b is not approved before the expiry of my VISA / I-94/ I797 then can I stay back in US till I hear from USCIS ..on my file

- Yes, you can stay in US even after I-94 expiry date. But if your decision did not come before 240 days then you can not work after 240 days but you're authorized to stay.
