H1b case 221(g)

Hi all,

I gave my H1b visa interview at New delhi embassy in Nov, 2011. Mine is EC model, My employer is Product development company. After interview, VO took all the documents and issued Green slip saying that "We are reviewing case".

On Feb 10,2012 , I got formal letter saying that we are sending case back to USCIS.

I am checking with USCIS website since than , but there is NOT update in my case. Currently it's showing old approved Petitition message saying that " Your petitiion has been approved on July 26,2011" but it's old approved petition, It means that status is NOT changed since old approved petition.

Does any body know that in how many days USCIS receives case back from US embassy?

How can I know that USCIS receive my case back? or USCIS is doing some progress in my case?

Pls. advice and share your experience. It's really appriciated.

It took 25 days for USCIS to reaffirm my petition upon receiving my case from US Consulate.

>> procedure is a follows -

Returned cases are least priority for USCIS

1) USCIS will review (typically 4-5 months)

2) They will issue a NOID or RFE to your employer explaining facts, Your employer responds to the same (1 months)

3) uscis reviews the case and affirms or deny your case (3-4) months

>> your options

either wait or search for a new h1 sponsor

How many days or months it took to receive your case from US consulate- India to USCIS?

Also ,

Pls. tell me did you get your H1b visa after reaffirmation of your petition?

In my case following are the dates :

Interview date : Nov,22nd, 2011.

Received decision letter from US embassy on : Feb 10th, 2012.

There is NO update since than from US embassy or USCIS.

How many days it take to send case from embassy to USCIS?

Is USCIS updates the status once they receive the case from USCIS?
