Considering that i have already worked for Profit organizations before and have already filed my H1b under the cap once, do i fall under the cap while making a switch from non profit to profit. wiweq Posted May 8, 2012 Report Share Posted May 8, 2012 Because you are already counted towards caps and you didn't complete your 6 yr quota, you won't be counted to the caps again. Link to comment

One more question would be can i start working for this new Profit making employer as soon as i get the receipt of H1b application? JoeF Posted May 9, 2012 Report Share Posted May 9, 2012 If you have been counted for the quota, you can freely switch between cap-exempt and non-exempt organizations. Just a simple H1 transfer. Link to comment

You can start working at receipt. Again, better to make sure this with your prospective employer or their attorney. Link to comment

I am planning to make a swtich during my H1b extension(after 6 years of current H1b) once i get my I140 (Green Card process) approved. I remember you guys telling me that i wont be counted towards cap for the 6 year quota but will i be counted towards cap if i plan to swtich from my current Non Profit to Profit firm once i am in my extension period (which would be after my 6 years).
