SOW is valid only for next two months

Hi All,

Can any one please share your thoughts.

I work for an MNC, and cuttently filed for a H1 b cap exemption premium request from India. However , the project support document SOW that I submitted is valid only till June 30th 2012. Our SOW gets exteneded by every quarter and the MSA is running from quite long with continous amendments from time to time.

So now what are my petition approval chances?

In case of approval, Will I get my petition approved , only till June 30th 2012

Is there any chance of RFE?

Requesting all one more time, if any of you have idea on this subject, kindly share your thoughts.

Just to put it in a simpler way, what factors decide the approval for petition and its end date in the case if H1 b cap exemption request?

1.Is it the SOW end date? or

2.Is it the I 797 end date? or

3.Is it upto the officer to decide on some end date randomly?

From personal experience, the SOW end date does not matter much if the adjudication process is beyond that date. One of the two things can happen in that case: either they will ask for an updated SOW through Request For Evidence (RFE) process or give you extension for the time period mentioned by your company.

USCIS does not have any posting in public domain, that I know of, that gives a clear guidance on this.
