Medical Issue

I'm on H1B. I've to go under a medical surgery, for which I need to take at least 3-4 months.

I'm working as a contractor, so I guess I've no option but to resign. If I resign and go for the surgery can I stay on H1B for the next 3-4 months without working? If yes, how long can I stay? If not, then what should I do? Please help me.

On H1, you are not working as contractor.

H1s are only for employees. You have an employer.

You can get a leave without pay because of a genuine reason. But make sure you maintain proper documentation (Doctor's letter, Hospital bills etc.) to support the leave without pay.
