Working on EAD

Hi,

My wife and my self got EADs. I am the primary applicant. My wife is on H4 status. can my wife start working on EAD? I want to continue on H1B for now. I hope there won't be any issues for my 485 or to her 485 applications as result of my wife using her EAD. can somebody please give more details on this scenario? thanks.

Yes she can start working on EAD while you continue to be on H1b.

If my wife starts working on EAD what will be my status? Is my EAD also gets the status of presently in USE. Eventhough, I still want to continue on H1B as it is valid till 2015. Does my employer need to be notified of my wife using her EAD?

A: Her using EAd has no effect on you, in this case your will continue on H1

A: There is no such status as "Presently in use"

As I explained, use of EAD is merely a technical thing related to authorization for work

A: Your employer has nothing to do with your wife's status.

You do not need to inform anything to your employer about your wife

Your strategy to continue on H1 is correct and appreciated

Your wife having an H4 base don your H1 will also be a safety net for your GC applications
