Regarding New H1B

Dear Sir,

I worked in USA on L1 from 2005 JUL to 2008 SEP and filed (transfer) to new H1B and worked on H1 from 2008 SEP to 2010 MAR. I came back to India in 2010 March and staying/working india tilll date.

Now, if my cuurent employer filed a new H1B.Shall I get 6 years time period to stay/work in USA?

(almost 2 years I came back from USA)

Generally, an indvidual who has already been counted agains the H1B cap may elect to use the time remaining under the initial 6 years or opt to file a new cap subject petition if s/he has spent at least one full year outside the U.S. prior to filing.
