mitgc Posted March 5, 2012 Report Share Posted March 5, 2012 Hi Guys, I have literally diff scenario here.. My I-485 was denied in 2008 due to visa screen unavailability. I-140 was approved and overall application was filed in Aug 2007 with EB3 category when PDs were current. I-140 is currently still valid, but I am going to travel on H4. So can I approach my employer again and if the case can be upgraded to EB2 and I can finish pending visa screen stuff ? is this really possible? Link to comment
