Rameshtrd Posted February 28, 2012 Report Share Posted February 28, 2012 My current H1B valid till May 15. My company field an extension and got RFE. The RFE is for client letter and SOW. We have responded back for RFE after 25 days and my H1B extension got denied last week. I am waiting for denial reasons from my company. I received my EAD & AP card this week and it valid for an year. My question: 1. Does my H1B denial impact my EAD, AP & GC processing. 2. Can continue on EAD without H1B. Link to comment

my2239 Posted February 29, 2012 Report Share Posted February 29, 2012 The H1 and Green Card application are separate The fact that your H1B is denied may mean that the evidence requested was not sufficient It is always safer to resubmit evidence / appeal accordingly As a 485 applicant you are safe only as long as there are no other independent problems with your 485 Example: No criminal problems, no other problems with your application etc., Without a back up status like H1, you run the risk of being instantly out of status the moment your 485 lands into trouble I mean you can always contest the USCIS decision but as you know, the situation is complicated Regarding use of your EAD, AP while your 485 is pending, that can happen as long as you file timely extensions and do not leave USA while any renewal application is pending Hope this helps Link to comment
