The new employer wants to get the H1B transferred to him and doesn't want me to be an employee of the first employer. Is there any support needed from the old employer from the H1B transfer process ? If yes what support is needed and does he have any authority to negatively impact the H1B transfer process ? Link to comment
kalyan_ac Posted February 20, 2012 Report Share Posted February 20, 2012 Do you have any contract with the current employer? Typically you wouldnt need any support from the current employer except the paystubs. Make sure not breaking any contract with the current employer. Link to comment
dreams11 Posted February 22, 2012 Report Share Posted February 22, 2012 What would be the impact of breaking the contract? I have contract with Company A "X" USD and also work for a year with them on H1b, W2. There is no job security so I applied for H1b transfer with company B. Link to comment
kalyan_ac Posted February 23, 2012 Report Share Posted February 23, 2012 If you did sign any contract as such, your employer can use that as legal document to get the money back. But on H1, there is no such thing called as contract. Link to comment
