I applied H1 on April 2010, but that employer(A) was a fraud, H1 petition has not yet been approved/denied, still it shows Initial Review. Meanwhile I applied for another H1 with another employer(B) in July 2011. My H1 got approved last week. Both of them have applied through COS. Incase my first H1 with employer(A) gets denied now, will the LAST RULE apply? Will it create any problem for the current approved H1 petition? Please reply. Thanks Link to comment

Attorney_13 Posted February 12, 2012 Report Share Posted February 12, 2012 In general, based on the information provided, if one is otherwise maintaining their current nonimmigrant status pursuant to their approved H1B petition, the denial of the other pending petition should not impact one's status.
