First and foremost, this is a PROPOSED rule, and as I understand it, has to go through 2-3(+) more steps before it would take effect. Unfortunately, there is no guarantee when, or even if, the proposed rule will be implemented and become effective.

Also, the proposed rule only applies to spouses on H-4 after the H-1B holder is past their 6 year limit (7th+ year extension) and has had an approved I-140 for a period of time (6 months?). It does not apply to all dependents, e.g. children.

On a personal note, I am very much hoping that this rule does get implemented and apply as soon as possible. As it stands, it would at least apply to my wife next year. This would be a huge plus, especially with trying to put 2 children through college in the U.S. on one income.
