dvihaanz Posted January 14, 2012 Report Share Posted January 14, 2012 Hi, I received this e-mail yesterday, The California Service Center has approved the following I-129 Petition for Nonimmigrant Worker that had been filed under the Premium Processing Program: Receipt Number: XXXXXXXXXXXXXXXX Petitioner: XXXXXXXXXXXXXXXX Beneficiary: XXXXXXXXXXXXXXX DOB: XXXXXXXXXXXXXX Classification: H1B Starting Validity Date: 02/01/12 Ending Validity Date: 01/31/13 Consulate notified (if applicable): MUMBAI I-94 # (if applicable): XXXXXXX924 The form I-797 Approval Notice will follow in the mail. > I entered USA on B1 visa and applied for H1B in November 2011. I got this email approval on 12nd Jan 2012. My problem is my I-94 for B1 expired on 8th of Jan 2012. What should i do now? Please help me with this. Thanx Link to comment
kuku82 Posted January 14, 2012 Report Share Posted January 14, 2012 it seems like your change of status is not approved as your I 94 expired earlier than your H1b starting date. You might need to go to India for visa stamping. Still you will come to know after you get actual notice. USCIS is inconsistent about this issue. I also changed my status from b1 to h1b. In my approval Email -the consulate notified section was blank, and I got I 797A notice with new I 94 attached. Link to comment
pontevecchio Posted January 14, 2012 Report Share Posted January 14, 2012 If your H1 approval came with an I94 you can start working AND YOU HAVE NO PROBLEMS. Give your sponsor a call and ask him. Link to comment
JoeF Posted January 14, 2012 Report Share Posted January 14, 2012 If the approval notice doesn't have an I-94 at the borrom (which seems likely), you will have to leave the country and get an H1 visa from the consulate listed. Link to comment
