OPT expiring, H1B pending. Can I work?

My Opt stem extension is expiring in Jan 20th.

H1B application is still under initial review.

The receipt date is October 11th, and i think there is still long time to wait until it comes.

I have asked the lawyer and she said since the case is pending, I can still work after expiring.

But i'm in doubt of the answer, it doesn't make sense that i can get payroll in grace period.

Does anyone have the same experience?

Will I get into trouble if i continue working after opt expires? Will it affect my h1 decision?
