H1 B 7 th year extension : Labor approved

Hi,

I am about to complete 6 years on H1 B by mid Jan 2012. However, my I-797 is valid till May 26 , 2012. Meanwhile, I have been informed by my employer that my Labor is approved (on Nov 28,2011) . The I-140 is not yet filed. Can I stay beyond mid Jan 2012 ? What are my options for staying beyond expiry of 6 years?

Since your Labor is approved using that you can file for H1B extension which would be 1 year. That is the best option i could see, since your I140 is not filed. If you file I140 premium processing and get it approved say my March, you can file for 3 year H1B extension , provided your PD is not current.
