vsthakur1 Posted January 7, 2012 Report Share Posted January 7, 2012 Hi, I am about to complete 6 years on H1 B by mid Jan 2012. However, my I-797 is valid till May 26 , 2012. Meanwhile, I have been informed by my employer that my Labor is approved (on Nov 28,2011) . The I-140 is not yet filed. Can I stay beyond mid Jan 2012 ? What are my options for staying beyond expiry of 6 years? Thanks, Vijay Link to comment
nipukumar Posted January 16, 2012 Report Share Posted January 16, 2012 Since your Labor is approved using that you can file for H1B extension which would be 1 year. That is the best option i could see, since your I140 is not filed. If you file I140 premium processing and get it approved say my March, you can file for 3 year H1B extension , provided your PD is not current. Link to comment
