GC2k6PD
I have I-485 pending and EAD & AP available. If I travel to home country for 2-3 months due to family emergency, can I work from there without violating any EAD terms. My employer is ok with remote work and willing to run payroll during this time. The other option is to take leave of absence for 3 months. Please advise, what to do in order not to risk pending AOS. JoeF
If you are outside the US, the EAD wouldn't matter at all. That only matters while you are in the US. You may be required to pay taxes in your home country, though. Link to comment
pontevecchio
You should be able to work remotely. What you do in your home country is immaterial. Link to comment
anilkaqua
Hi, If the derivative of the AOS process is currently on H1 and has received EAD. How can the derivative shift to EAD from H1? Once after shifting to EAD, what are the terms for working? like minimum number of working hours etc. Can anyone please tell me. Thanks in Advance Link to comment
pontevecchio
Why is this even a question? The derivative would indicate to HR of any company where he is looking that he is using EAD as his job authorization. The contract with the employis not the remit of the state unless illegal by State law. Link to comment
anilkaqua
Thank you for your reply. However i did not understand the part "contract with the employis not the remit of the state unless illegal by State law". I was looking for more information about the minimum number of hours one should work while on EAD. In this case can the derivative who has EAD can stay home(even if her prior status is H1) while the primary who also has EAD will still be working. Link to comment
