vmaha
I have I140 eb2 approved from ex employer A. Now I am with employer B who got 3 yr extention on my h1b recently when my priority date was NOT current. This month my priority date is now current. I am getting new offer from employer C. Can I get again 3 yr extention? Company C's is saying they may get only 1 yr since priority date is current now. Link to comment
Attorney_22
Company C is correct. Once an individual’s priority date becomes current and that individual has already exhausted the initial six years in H1B status, they are only eligible for H1B extensions in one year increments provided the I-140 is still valid. If you have additional questions, please contact a qualified U.S. immigration attorney. Link to comment
vmaha
Thanks for quick reply. Company C's immigraiton lawyer spoke to me and told me same. So thanks for your confirmaiton too. Only thing you mentioned - 'provided I140 valid' - what dose this means? Original company has not cancelled it? Link to comment
