I have labor and I-140 approved in EB3 (priority date Nov 2007). My company is going to be discontinued for some reason. My I-94 is valid up to 1st of October 2012. Can I transfer my H1B now. Please advise me possible ways to stay in US until my EB3 date is current. Link to comment
vmaha Posted January 5, 2012 Report Share Posted January 5, 2012 you can join new company but you will need at least copy of approved I140 with you. Normally 3 yr extention is granted. You will have to do new PERM and new 140 with new employer. You can use Nov 2007 priroity date. When you are doing new PERM/140, may be its worth to try for Eb2, now that you have gained 7 yr of experince with current company. Link to comment
