pontevecchio Posted December 31, 2011 Report Share Posted December 31, 2011 First of all neither you nor your spouse can apply for a H1 petition. You would need to file a sponsor who would file for her. There is no time limit. Link to comment

It will not be an amendment but a new H1B petition using the old H1b petition quota. Will that cause any problem? I mean, will they give RFE on why a new petition is being applied by same employer when the old petition was valid but the visa was denied? Link to comment
