srisat Posted December 22, 2011 Report Share Posted December 22, 2011 H1B Expiring Feb 28 2012 PERM APPLIED and APPROVED, PERM Applied DATE: July 6th 2011 (under 365 days, labor applied in 6th year) I-140 APPLIED PREMIUM - WAITING FOR APPROVA (have i-140 receipt) am i eligible for 7th year extension even if i-140 is still pending by February of 2012 ? I am planning to applying for extension, expecting a 1 year extension from March 2012. What is the best advice? is 7th year extension possible? Link to comment
maddygonemad Posted December 22, 2011 Report Share Posted December 22, 2011 Your 7th year extension is not possible until your 140 is approved, since the PERM was applied less that 365 days of your h1b expiry. But you can do one thing. In case your 140 doesnt get approved before Feb 28 2012, you can leave the country and wait until 140 gets approved. Once your 140 is approved, you can apply for extension and you have to go for stamping. Best of Luck. Link to comment
CriticalSection Posted December 31, 2011 Report Share Posted December 31, 2011 I am in a similar boat. My Perm has been applied on 3rd Nov 2011. My H1 is expiring on Feb 2011. I am banking for approval of PERM + i140 by next 40 days. If not, I am researching about AC21 (21st century act) by which one can get 7th year extension regardless of current status / country of residence. Please correct me if required. Link to comment
