thelastresort
Hello friends, My h1 petition is expiring in Feb 2012. I am planning to travel to India and would have to get my visa stamp as this is my first h1 visa. Is it safe to go for stamping and travel when h1 petition is expiring in 5-6 months? Thank you for reading. Link to comment

Blue484
That depends on your case. If possible try and travel when there is some more time. I was in a similar case with a little more than 4 months and am stuck since 3.5 months. Ofcourse you can apply for an extenstion in the meanwhile Link to comment
leo_maverick
If you are in need to visit your home country, then you should be safe as long as you have all the docs to support your H-1B petition. Good Luck! Link to comment
sanjivvinaik
These days NO. If you can then postpone your trip and get the approval so in case even if you have to wait for some time still your I797 will be valid. Link to comment
