My H1b approved on April 2011 and my now husband is on H4 from F1. My employer is ready to file GC. My Q is we never went out of US since our visa status change. On my PP still F2 visa sticker. Once we file GC, can we visit India for visa stamp for H1 & H4? Is there any problem? thanks Link to comment
pontevecchio Posted November 23, 2011 Report Share Posted November 23, 2011 H1 and H4 are considered dual intent visas. Hence you can start the Gc proceedings while in this status. The H1 visa stamp will be on merits. Link to comment
