I Left my old company which filed my labor two years back ( Got H1B transfer and joined a full time job ) .

I have approved I -140 and now my PD is current (Sept 2007) with this old employer .

I am on my last year of H1B (6-year H1B will expire in Nov 2012) .Can I still do the H1B transfer to the old company and start filing my I-485 /extension ?

What are the chances of getting a RFE or getting approved ?

Please let me know any issue involved

Thank you!

Generally, as long as the I-140 is still valid with the petitioning employer and that employer is willing to hire you pursuant to the terms of the previously filed and approved labor certification and I-140, you are eligible to file your I-485 based on this offer of employment. In this situation you can either have the I-140 petitioning employer file an H1B change of employer and extension petition on your behalf then file the I-485, or you can file your I-485 immediately. If you have additional questions it is advisable to contact a qualified U.S. immigration attorney directly.
