Guest Posted November 15, 2011 Report Share Posted November 15, 2011 Hi USCIS updated saying they received 56,300 application as for 65,000 cap and this is as of November 14th 2011. And website says "6,800 visas are set aside from the cap of 65,000 during each fiscal year for the H-1B1 program under the terms of the legislation implementing the U.S.-Chile and U.S.-Singapore Free Trade Agreements." 56,300 + 6800 = 63,100. 65,000 - 63,100 = 1900 Does this mean only 1900 applications are available in general category? Or 6800 is already in 56,300 which makes availability to 8700? I am from India Thank you for your replies.... Link to comment

The way I read it, USCIS is posting the count towards the total cap regardless of the type of quota. Hence I think there is more than 1900 visas available. Does anyone have any real insight on this? Thanks. Edit: I think the available visa numbers for the general quota are between 1900 and 8700 because we don't exactly know how many they have received for Chile and Singapore! Link to comment
roodge Posted November 15, 2011 Report Share Posted November 15, 2011 I have also heard that unused numbers of the Singapore and Chile cap from the previous year are added to the current fiscal year. For example, in 2010, about 6350 singapore and chile visas were unused and so the actual regular cap was 58200+6350=64550 for FY 2010. So if history is any indication the unused Singapore & Chile numbers could be about 6000 (my estimate), which would make FY2012 numbers to be about 58200+6000=64200 from which 64200-56300=7900 left That is my best guess. But of course real insight from a lawyer could give us a better answer. Link to comment

Lets see if anyone else will answer Reality is its 1900. 6800 is kept aside for chile/singapore, if it is left over at the end of the year they will spill it over to next year quota, but can not be used this year. If there are any spill overs from last year yuo can count them with 1900 currenly available. I hope it answers your question. Link to comment
