Simultaneous L1 to H1 transfer from two employers

Hi Seniors,

Need your advise...

I have filed COS from L1 to H1 through company A under premium processing category but received an RFE. It's over 20 days now and the case is still pending.

Company At has responded to the query but we haven't heard anything yet.

Meanwhile, I have got an offer from another company B who is willing to file a new L1 to H1. I would also prefer to join Company B as it's a much more reputed one and is providing better compensation.

My questions are -

1. Can I file L1 to H1 transfer to company B while the transfer process through company A (filed through COS) is still in RFE?

2. If 1 is possible, then what if the Company A's H1, which was filed through COS, comes through before Company B's L1 to H1 request process is completed? Will Company B still be able to transfer my L1 to H1?

If you are in valid L1 status now...

1. Yes

2. Once a COS to H1 is approved your L1 status is gone. So if A gets the H1 with COS approved you can join them or leave and wait for the petition by B to be approved and come back with the H1 visa.
